Three major chemical manufacturers have agreed to pay North Carolina $455 million to settle litigation over widespread contamination of drinking water with PFAS, commonly known as "forever chemicals." Chemours, DuPont, and Corteva reached the agreement with the state and 11 local government entities after lawsuits alleged that Chemours' Fayetteville Works manufacturing facility and other historical discharge sites polluted municipal water supplies across the region.
PFAS are synthetic compounds engineered to resist heat, oil, and water degradation. This durability makes them useful in industrial applications but also means they persist indefinitely in the environment and human tissue. The chemical class includes over 12,000 variants, with perfluorooctanoic acid and perfluorooctane sulfonate among the most studied contaminants.
The North Carolina settlement represents the latest in a cascade of major litigation victories for states and municipalities challenging chemical manufacturers over PFAS contamination. The three defendants previously agreed to pay New Jersey $450 million in 2024 for similar PFAS-related water pollution claims. Chemours operates the Fayetteville Works facility in Cumberland County, North Carolina, a major producer of refrigerants and other fluorinated chemicals. Historical operations at the site and other company locations released PFAS into groundwater systems that feed public water supplies serving hundreds of thousands of residents. Testing has detected PFAS compounds in drinking water wells and municipal treatment systems across multiple North Carolina counties.
The contamination affects both urban and rural water systems. Municipal utilities have incurred substantial costs installing and maintaining specialized water treatment equipment needed to remove PFAS below federal health advisory levels. The EPA set interim drinking water standards in 2023 establishing enforceable limits for four PFAS compounds, marking the first federal regulation of the chemical class.
The settlement allocation directs funds toward water system improvements, health monitoring programs, and natural resource restoration. North Carolina will use the money to support municipalities in upgrading treatment infrastructure and conducting source water protection initiatives.
